Terms and Conditions of Services
FRESH-N-SO CLEAN BINS
TERMS & CONDITIONS
Effective Date: October 5, 2026
Last Updated: October 5, 2026
These Terms & Conditions (“Terms”) govern services provided by Fresh-N-So Clean Bins (“Fresh-N-So Clean Bins,” “we,” “us,” or “our”) to our customers (“Customer,” “you,” or “your”).
By purchasing, scheduling, maintaining a recurring service plan for, or otherwise using our services, you agree to the Terms applicable to your service and any separate authorizations or consents you provide.
Please read these Terms carefully.
1. OUR SERVICES
Fresh-N-So Clean Bins provides professional trash, recycling, and/or organics bin cleaning and related exterior cleaning services.
Fresh-N-So Clean Bins is an independent cleaning service.
We are not a garbage or waste collection company and are not affiliated with your municipal or private waste collection provider unless expressly stated otherwise.
We do not provide routine garbage collection, transportation, or disposal as part of our bin cleaning service.
Our ability to clean a bin depends upon the bin being reasonably accessible and in a condition suitable for cleaning.
2. SERVICE SCHEDULING
Bin cleaning services are generally scheduled in coordination with the Customer's regular waste collection schedule so that bins can be cleaned after they have been emptied.
Service dates, routes, and arrival times may vary due to waste collection timing, route scheduling, traffic, weather, equipment conditions, staffing, accessibility, and other operational circumstances.
Unless Fresh-N-So Clean Bins expressly confirms otherwise, an estimated arrival time or service window is not a guaranteed appointment time.
Customers should leave bins accessible after waste collection until the scheduled cleaning has been completed.
3. ADVANCE SERVICE REMINDERS
Fresh-N-So Clean Bins generally provides advance reminders approximately:
Two (2) days before the scheduled cleaning; and
One (1) day before the scheduled cleaning.
Reminders may be provided through email, SMS/text message, or another communication method authorized or provided by the Customer.
These reminders give Customers an opportunity to prepare their bins, verify waste collection, report a delayed or missed collection, provide access information, or notify us of another issue that may affect service.
Customers are responsible for providing accurate and current contact information and making reasonable efforts to review service-related communications.
Failure to receive or review a reminder does not automatically cancel or postpone a service otherwise appearing on the Customer's schedule.
4. MY ROUTE PRO CUSTOMER ACCOUNT
Customers may have access to a My Route Pro customer account or portal for managing information related to their Fresh-N-So Clean Bins service.
Customers are encouraged to register for and use their account.
Depending on the features currently available, Customers may be able to:
View upcoming scheduled services;
Review their service schedule;
Leave service notes or instructions;
Provide information concerning accessibility; and
Notify us whether bins have been collected or emptied.
Use of the customer portal is encouraged but is not the only way to communicate with Fresh-N-So Clean Bins.
Customers may also contact us using available methods such as telephone, SMS/text message, email, or other communication methods we make available.
5. CUSTOMER RESPONSIBILITIES
Customers are responsible for making reasonable efforts to ensure that bins scheduled for cleaning are:
Available on the scheduled service date;
Located where our personnel can reasonably access them;
Empty or sufficiently empty to permit cleaning;
Free from unsafe or prohibited materials; and
Otherwise in a condition that reasonably permits service.
Customers should notify us as soon as reasonably possible if they become aware of a condition that may prevent service.
This includes delayed waste collection, vacations, locked gates, inaccessible bins, construction, vehicles blocking access, or other circumstances affecting our ability to reach or clean the bins.
6. PREPAID SERVICES
All scheduled cleanings are prepaid.
Payment is processed before the scheduled service is performed.
Prepayment reserves service capacity and allows Fresh-N-So Clean Bins to schedule personnel, equipment, vehicle time, and route capacity for the Customer's appointment.
Payment for a scheduled cleaning does not mean that the service is considered completed before the cleaning occurs.
Customers remain responsible for making reasonable efforts to have their bins available, accessible, and ready for service.
7. MINIMUM SERVICE REQUIREMENT
Unless a particular offer or plan expressly provides otherwise, Fresh-N-So Clean Bins requires a minimum of two (2) scheduled cleaning services.
Customers who have already completed at least two scheduled cleaning services have satisfied this requirement.
Customers who have not yet completed two scheduled cleaning services remain subject to the minimum requirement, subject to applicable cancellation rights and applicable law.
8. MISSED OR DELAYED WASTE COLLECTION
Fresh-N-So Clean Bins does not control the Customer's municipal or private waste collection provider.
If the waste collection provider has not emptied the Customer's bins as expected, the Customer should notify Fresh-N-So Clean Bins as soon as they become aware of the delay.
Customers may notify us through available My Route Pro features or by telephone, SMS/text message, email, or another communication method we make available.
When We Are Notified
When we receive notice that waste collection has been delayed, we will make reasonable efforts to adjust the Customer's cleaning to later that day or, when necessary, the following day.
The exact adjusted service time will depend on when the bins are emptied, route availability, technician availability, operating hours, and other service conditions.
Customers should notify us once the bins have been emptied when requested or use an available My Route Pro feature to update the collection status.
An adjusted service does not create a guaranteed arrival time.
If We Have Already Arrived
Customers are encouraged to notify us before our technician arrives whenever reasonably possible.
If we arrive and discover that the waste collection provider has not emptied the bins, we will evaluate the circumstances and, when reasonably possible, attempt to service the property later that day or the following day.
A second trip cannot always be guaranteed.
If only a small amount of ordinary waste remains, our technician may be able to proceed under the handling policy described below.
9. BINS CONTAINING GARBAGE OR OTHER MATERIAL
Bins should be empty for cleaning.
Fresh-N-So Clean Bins does not provide waste collection or disposal as part of its normal bin cleaning service.
Small Amounts of Garbage
If a bin contains a small amount of ordinary garbage or other removable material that our technician determines can reasonably and safely be handled, we may temporarily bag or remove the material, clean the bin, and return the material to the bin after cleaning.
A $20 handling fee per affected bin will apply when this additional handling is performed.
The handling fee compensates Fresh-N-So Clean Bins for the additional labor involved.
It is not a garbage collection or disposal charge.
Excessive or Unsafe Contents
Fresh-N-So Clean Bins may refuse to handle materials that our technician reasonably determines are:
Excessive in quantity;
Excessively heavy;
Hazardous or potentially hazardous;
Sharp or dangerous;
Leaking;
Contaminated;
Prohibited;
Unsafe; or
Otherwise inappropriate for our personnel to handle.
If the contents prevent safe or reasonable cleaning, we may be unable to clean the affected bin.
10. INACCESSIBLE, UNAVAILABLE, OR NOT-READY BINS
If our technician arrives and a scheduled bin cannot be cleaned because it is inaccessible, unavailable, blocked, behind a locked gate, not at the expected service location, excessively full, unsafe, or otherwise not reasonably ready for service, Fresh-N-So Clean Bins will make reasonable efforts, when practical, to contact the Customer.
Contact and Waiting Period
When circumstances and the route schedule permit, our technician may wait up to fifteen (15) minutes for the Customer to provide access, relocate the bin, or otherwise make the bin ready for cleaning.
The fifteen-minute period is a maximum potential waiting period and is not guaranteed.
Our technicians must continue servicing other Customers on their scheduled routes.
An Attempted Visit Is Not a Completed Cleaning
Fresh-N-So Clean Bins will not represent a bin as having received a completed cleaning merely because our technician traveled to the property.
However, the Customer acknowledges that personnel, equipment, vehicle time, fuel, travel time, and route capacity may already have been committed to the appointment.
For that reason, a complimentary return trip or immediate rescheduling is not automatically guaranteed when the inability to perform service resulted from the bin being inaccessible, unavailable, excessively full, unsafe, or otherwise not ready for service.
Return Visits
If our technician must leave, a same-day return visit is not guaranteed.
Customers should contact us promptly to discuss the situation.
Depending on the circumstances and route availability, Fresh-N-So Clean Bins may offer a later return, rescheduling, account adjustment, or another reasonable resolution.
Delayed waste collection by the Customer's waste provider is handled separately under Section 8.
11. PROPERTY ACCESS
Customers may authorize Fresh-N-So Clean Bins personnel to access portions of their property for purposes reasonably necessary to locate, retrieve, clean, or return bins.
Authorized areas may include driveways, side yards, gated areas, designated bin storage locations, or other areas the Customer has authorized us to access.
By providing access instructions, gate codes, placement instructions, or similar directions, the Customer represents that they have authority to grant such access.
Our personnel will make reasonable efforts to limit access to areas necessary to perform the requested service.
Customers should notify us of known hazards, animals, access restrictions, or other conditions affecting safe access.
12. PETS, ANIMALS & PROPERTY HAZARDS
Customers are responsible for ensuring that pets and other animals are safely secured and do not interfere with our personnel.
Customers should inform us of known property conditions that may create a safety risk.
Fresh-N-So Clean Bins may decline, postpone, or discontinue service when our personnel reasonably determine that conditions are unsafe.
13. VACATIONS & CUSTOMER-REQUESTED POSTPONEMENTS
Customers may request that an upcoming prepaid cleaning be postponed because of vacation, travel, temporary absence, or another scheduling need.
Vacation Scheduling
Services may be postponed in weekly increments corresponding to the Customer's expected absence.
For example, a service may be postponed one week, two weeks, four weeks, or another appropriate number of weeks based on the Customer's vacation dates.
Preferred Dates
Customers may request a preferred rescheduled date.
Fresh-N-So Clean Bins will make reasonable efforts to accommodate the requested date when route and scheduling availability permit.
A preferred date is not guaranteed until confirmed.
If the Customer does not provide a preferred date, the service will generally be postponed to the following week, unless the Customer's stated absence requires a later date.
Payment for a Postponed Service
The Customer is not charged a second time for the same properly postponed prepaid cleaning.
The original payment remains associated with the postponed service.
A properly postponed service is not considered completed merely because its original service date passed.
14. RESCHEDULING A PREPAID CLEANING
If a Customer needs to change an upcoming cleaning but still intends to receive the service, the Customer should request a postponement or rescheduling rather than cancellation.
When a prepaid cleaning is properly rescheduled, its payment remains associated with that cleaning.
Rescheduling is subject to route availability.
Customers should provide as much advance notice as reasonably possible.
15. SERVICE PHOTOGRAPHS & DOCUMENTATION
Fresh-N-So Clean Bins may take reasonable photographs of bins and relevant service areas for legitimate service and business purposes, including:
Documenting completed work;
Recording bin condition;
Documenting bin location;
Documenting accessibility problems;
Documenting garbage or material preventing service;
Quality control;
Resolving customer questions or disputes;
Training and operational improvement; and
Maintaining service records.
We will make reasonable efforts to limit service-documentation photographs to areas relevant to the service.
Permission for promotional or marketing use of photographs may be handled separately where appropriate.
16. CLEANING RESULTS
Fresh-N-So Clean Bins strives to thoroughly clean bins using our normal professional cleaning process.
Results may vary based on the bin's age, material, condition, prior use, staining, discoloration, residue, adhesives, paint, damage, odors, or other characteristics.
We cannot guarantee complete removal of every stain, discoloration, mark, residue, or odor.
Normal staining, discoloration, wear, or pre-existing damage does not by itself indicate that cleaning was not properly performed.
17. EQUIPMENT OR OPERATIONAL FAILURE
If Fresh-N-So Clean Bins is unable to complete all or part of a prepaid service because of equipment failure or another operational issue within our responsibility, the Customer will not lose the value of the portion of service we were unable to perform.
For a completely unperformed service, we may:
Reschedule the cleaning;
Apply the prepaid amount as an account credit; or
Issue an applicable refund.
Partial-Service Credits
When a package includes multiple bins and only some can be serviced because of an equipment or operational failure within our responsibility, an account credit will generally be calculated according to the percentage of scheduled bins that were not serviced.
The general calculation is:
Number of Unserviced Bins ÷ Total Number of Bins Scheduled = Percentage Credit
Example 1
4 bins scheduled
2 bins successfully cleaned
2 bins not cleaned due to our equipment failure
2 ÷ 4 = 50%
Credit: 50% of the applicable prepaid service charge
Example 2
3 bins scheduled
2 bins successfully cleaned
1 bin not cleaned due to our equipment failure
1 ÷ 3 = approximately 33.33%
Credit: approximately 33.33% of the applicable prepaid service charge
Credits will be calculated against the applicable prepaid service amount and rounded to the nearest cent where necessary.
This proportional credit policy applies when the incomplete service results from circumstances within Fresh-N-So Clean Bins' responsibility.
18. CUSTOMER OR THIRD-PARTY CONDITIONS
The proportional credit policy in Section 17 does not automatically apply when we arrive prepared to perform service but a bin cannot be cleaned because of circumstances outside our reasonable control.
Examples include:
An inaccessible bin;
A bin not placed out for service;
A locked gate;
A vehicle or other obstruction;
Excessive garbage;
Unsafe or prohibited material;
A bin removed from the service location;
Delayed waste collection; or
Another Customer-controlled or third-party condition.
Customers should contact us regarding these situations.
Depending on the circumstances, prior notification, and route availability, Fresh-N-So Clean Bins may provide rescheduling, a return visit, an account adjustment, or another reasonable accommodation.
19. MULTIPLE BINS & DIFFERENT CAUSES
When multiple bins are scheduled, each affected bin may be evaluated individually.
For example, if four bins are scheduled and:
Two are successfully cleaned;
One cannot be cleaned because of our equipment failure; and
One cannot be cleaned because it contains excessive garbage,
the bin affected by our equipment failure may qualify for a proportional credit, while the full bin will be handled under the applicable garbage/not-ready policy.
This allows any service adjustment to reflect the actual reason each portion of the service could or could not be completed.
20. RECURRING SERVICE PLANS
Customers enrolled in recurring service authorize Fresh-N-So Clean Bins to schedule services according to the frequency selected at enrollment or subsequently agreed upon.
Recurring service continues until canceled in accordance with these Terms and applicable law.
The applicable service frequency, pricing, and other material terms will be disclosed in connection with enrollment or an agreed change in service.
Existing Customers may have pricing or service arrangements that differ from those currently offered to new Customers.
Changes to pricing offered to new Customers do not automatically change an existing Customer's rate.
If Fresh-N-So Clean Bins proposes to change an existing Customer's recurring price or other material recurring-service terms, we will provide any notice and obtain any consent required by applicable law before the change becomes effective.
21. RECURRING PAYMENT AUTHORIZATION
Customers enrolled in recurring billing authorize Fresh-N-So Clean Bins and its payment processor to charge the payment method provided by the Customer for scheduled services and other authorized charges associated with the Customer's account.
Scheduled services are prepaid and may therefore be charged before the scheduled service date.
The amount and frequency of recurring charges will be based on the Customer's applicable service plan and agreed pricing.
The Customer is responsible for maintaining valid and current payment information.
If payment cannot be processed, service may be delayed or suspended while the payment issue is resolved.
Recurring payment authorization remains in effect until canceled or otherwise revoked in accordance with applicable service terms and applicable law.
22. CANCELING RECURRING SERVICE
Canceling recurring service is different from rescheduling an individual cleaning.
A Customer who wishes to discontinue recurring service should clearly notify Fresh-N-So Clean Bins that they wish to cancel their recurring service or subscription.
Customers may request cancellation using the cancellation methods we make available, including email or another available contact method.
Once cancellation becomes effective, future recurring service and recurring charges will stop in accordance with applicable law.
If the Customer has already prepaid for a cleaning that has not yet been performed when recurring service is canceled, the Customer may, as applicable:
Receive the prepaid cleaning as scheduled;
Request an eligible rescheduling of that cleaning; or
Receive a refund for the unperformed prepaid service.
Completed services are not refundable merely because the Customer subsequently cancels recurring service.
Nothing in this section limits cancellation rights required by applicable law.
23. REFUNDS & ACCOUNT CREDITS
Refunds, when applicable, generally relate to prepaid services that have not been performed.
If Fresh-N-So Clean Bins is responsible for being unable to perform all or part of a prepaid service, the Customer will not lose the value of the unperformed portion.
Depending on the circumstances, the remedy may include:
Rescheduling;
Account credit; or
An applicable refund.
Account credits resulting from partial service may be calculated according to Section 17.
If recurring service is canceled while an eligible credit remains on the Customer's account for service Fresh-N-So Clean Bins did not perform, the remaining eligible amount will be handled in accordance with the cancellation terms and applicable law.
Nothing in these Terms restricts any refund, dispute, or consumer right that cannot lawfully be waived.
24. CUSTOMER SERVICE CONCERNS
Customers should contact Fresh-N-So Clean Bins as soon as reasonably possible if they believe:
A scheduled cleaning was missed;
One or more bins were not cleaned;
A cleaning was only partially completed;
A service was performed incorrectly;
A handling fee was incorrectly charged;
There is an incorrect charge;
Their waste collection was delayed;
There was an access problem; or
Another issue occurred with their service.
Prompt communication gives us the best opportunity to review the circumstances and determine an appropriate resolution.
We may review service photographs, technician notes, communications, route information, payment records, and other relevant service records.
25. WEATHER & CONDITIONS OUTSIDE OUR CONTROL
Services may be delayed, modified, postponed, or rescheduled because of circumstances reasonably outside our control, including severe weather, unsafe conditions, road closures, emergencies, governmental restrictions, widespread waste collection delays, or similar events.
When reasonably possible, we will communicate significant scheduling changes to affected Customers.
26. EMAIL COMMUNICATIONS
Fresh-N-So Clean Bins may use the email address provided by the Customer for transactional and service-related communications.
These communications may include:
Appointment confirmations;
Service reminders;
Receipts;
Billing information;
Account notices;
Service updates;
Accessibility questions;
Policy or Terms updates; and
Other communications reasonably related to the Customer's service.
Marketing communications, where applicable, will be handled in accordance with applicable law and available opt-out rights.
27. SMS/TEXT COMMUNICATIONS
Customers who provide appropriate consent may receive SMS/text communications from Fresh-N-So Clean Bins.
Messages may include service reminders, scheduling information, arrival information, accessibility questions, service updates, account communications, and other service-related information.
Message and data rates may apply.
Where applicable, Customers may withdraw consent to receive non-essential text communications using the available opt-out method or by contacting us.
Consent to receive marketing text messages, if offered, is not a condition of purchasing services.
Transactional/service-related communications and marketing communications may be subject to different consent requirements.
28. CUSTOMER CONTACT INFORMATION
Customers are responsible for providing accurate contact information and keeping it reasonably current.
Fresh-N-So Clean Bins is not responsible for a Customer's failure to receive communications because of incorrect, outdated, blocked, or otherwise unusable contact information supplied by the Customer.
29. PRICING & ADDITIONAL CHARGES
Pricing is based on the Customer's applicable service plan, number of bins, service frequency, and other applicable service characteristics.
Additional services or conditions requiring work outside normal bin cleaning may result in additional charges when properly disclosed and applicable.
This includes the $20-per-bin handling fee described in Section 9.
30. CUSTOMER-OWNED OR THIRD-PARTY BINS
Bins may be owned by the Customer, municipality, waste collection provider, property owner, homeowners association, or another third party.
The Customer is responsible for ensuring that they have any authorization reasonably necessary for Fresh-N-So Clean Bins to clean the bins presented for service.
31. PRE-EXISTING DAMAGE
Fresh-N-So Clean Bins will exercise reasonable care when providing services.
We are not responsible for ordinary wear, pre-existing damage, deterioration, structural defects, loose or defective bin components, or other conditions that existed before our service.
Customers should notify us promptly if they believe our personnel caused damage so that the matter can be investigated.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
32. RIGHT TO REFUSE, SUSPEND OR DISCONTINUE SERVICE
Fresh-N-So Clean Bins may refuse, suspend, or discontinue service when reasonably necessary because of circumstances including:
Unsafe conditions;
Threatening, abusive, or inappropriate conduct toward personnel;
Hazardous materials;
Repeated inability to safely access the service area;
Unresolved payment issues;
Misuse of services;
Materially inaccurate service information; or
Other circumstances making continued service unsafe, unlawful, or commercially unreasonable.
Any eligible prepaid amount relating to future services that will not be provided will be handled in accordance with these Terms and applicable law.
33. CHANGES TO THESE TERMS
Fresh-N-So Clean Bins may update these Terms from time to time to reflect changes in services, operations, policies, pricing structures, or legal requirements.
When required by law, we will provide notice and/or obtain consent before a material change becomes effective for an existing Customer.
A change to these Terms does not, by itself, change an existing Customer's agreed recurring price.
The version made available on our website will identify its effective or last-updated date.
34. ELECTRONIC ACKNOWLEDGMENTS & CONSENT
Where permitted by law, Fresh-N-So Clean Bins may provide Terms, notices, disclosures, acknowledgments, and other records electronically.
Customers may also be asked to provide electronic acknowledgment or consent through an online form, checkbox, electronic signature, or similar method.
Separate consent may be requested for specific activities, including recurring payments, SMS/text communications, property access, photographs, or other matters where separate authorization is appropriate.
An acknowledgment that a Customer received or reviewed these Terms is not intended to substitute for separate affirmative consent when applicable law requires separate consent.
35. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
An invalid provision will be limited or interpreted only to the extent reasonably necessary where permitted by law.
36. NO WAIVER
Fresh-N-So Clean Bins' failure to enforce a provision of these Terms on one occasion does not permanently waive that provision or our ability to enforce it in the future.
37. GOVERNING LAW
These Terms are governed by applicable federal law and the laws of the State of California.
Nothing in these Terms is intended to waive a Customer's rights under applicable consumer protection laws.
